Orders and acceptance
Prices and availability shown on this website are an invitation to enquire, not a binding offer. Seed availability changes with each collection season.
A contract is formed only when we confirm your order in writing and issue a proforma or tax invoice. We may decline or cancel an order before dispatch — for example where seed is no longer available, or where the price shown was incorrect.
Pricing errors
If a price is displayed or quoted incorrectly due to an error, we will tell you before dispatch and you may either confirm the order at the corrected price or cancel it for a full refund of anything already paid.
Payment and taxes
Unless we have agreed credit terms in writing, payment is due in full against a proforma invoice before dispatch. We accept bank transfer (NEFT/RTGS/IMPS) and UPI.
Prices are exclusive of GST unless stated otherwise. GST is charged at the applicable rate and shown separately on the tax invoice. Freight, where applicable, is charged in addition and shown on the invoice.
Delivery, risk and title
Delivery timelines are estimates given in good faith and depend on the carrier and destination. Time is not of the essence unless we have agreed a delivery date in writing.
Risk in the goods passes to you on delivery to you or to your nominated carrier. Title passes when we have received payment in full.
Nature of the goods
Seed is a natural, perishable, biological product. Any germination figure we state relates to a test carried out on that lot under controlled conditions. Field performance additionally depends on storage after delivery, sowing method, pre-treatment, soil, irrigation, weather, pests and management, which are outside our control.
Any advice we give on species selection or sowing is offered in good faith based on the information you provide, and does not amount to a guarantee of a particular field result.
Cancellation and returns
You may cancel an order at no cost before it is dispatched. Once dispatched, our Refund & Replacement Policy applies.
Because seed viability depends on storage conditions we cannot verify once goods have left us, we do not accept returns of opened or partly used lots except where a quality claim is upheld.
Liability
Where a claim relating to the goods is upheld, our liability is limited to replacing the affected lot or refunding the price paid for it, at our option.
To the extent permitted by law, we are not liable for indirect or consequential loss, including loss of crop, loss of profit, plantation establishment costs or labour costs.
Nothing in these terms limits liability that cannot be limited by law.
Intellectual property
The content of this website, including text, product data, photographs and the Devnagri name and logo, belongs to us or our licensors and may not be copied or reused commercially without our written permission.
Governing law and jurisdiction
These terms are governed by the laws of India. The courts at Dehradun, Uttarakhand have exclusive jurisdiction over any dispute arising from them.
